You agree and represent and warrant that your use of the GFM.tv will comply with applicable laws, ordinances and regulations. At any time, GFM.tv may terminate this Agreement and may halt any pending listings or sales at any time without notice to you.

Modification of These Terms of Use

    GFM.TV (GLOBAL FILM MARKET INC.) reserves the right to change the terms, conditions, and notices under which the services of GFM.TV (GLOBAL FILM MARKET INC.) is offered, including but not limited to the changes associated with the use of the GFM.TV (GLOBAL FILM MARKET INC.).

    We urge that you read GFM.tv's Privacy Policy which governs the protection and use of each User's information in GFM.tv's possession. Each User hereby accepts the Privacy Policy and any updates and amendments thereto. Each User acknowledges that GFM.tv may change the Privacy Policy from time to time provided that GFM.tv shall make available the updated version of the Privacy Policy on the Site at all times. Your continuation of use of the Site shall be deemed to be your acceptance of the Privacy Policy which is then displayed on the Site at the time of such use.

GFM.tv Inbox

    GFM.tv may assign a web-based email account with limited storage space for the User to send or receive email (the "Email Account"). The User shall be responsible for all users and the content of all the messages communicated through the Email Account, as well as the consequences of any such message.

    The Registered User shall not use the Email Account for junk mail, chain letters or spamming or the transmission of any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. Further, the Registered User shall not use the Email Account to publish, distribute, transmit or circulate any unsolicited advertising or promotional information or any content that is obscene, indecent, seditious, offensive, defamatory, threatening, or which incites or results in causing racial hatred, discrimination, menace or breach of confidence.

License and Site Access

    GFM.tv grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of GFM.tv. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of GFM.tv. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of GFM.tv without express written consent. You may not use any meta tags or any other "hidden text" utilizing GFM.tv's name or trademarks without the express written consent of GFM.tv. Any unauthorized use terminates the permission or license granted by GFM.tv. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of GFM.tv so long as the link does not portray GFM.tv, or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any GFM.tv logo or other proprietary graphic or trademark as part of the link without express written permission.

Your Account

    If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use GFM.tv only with involvement of a parent or guardian. GFM.tv reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Reviews, Comments, Communications, and other content

    Visitors may post reviews, comments, photos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content.     If you do post content or submit material, and unless we indicate otherwise, you grant GFM.tv a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant GFM.tv and sub licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify GFM.tv for all claims resulting from content you supply. GFM.tv has the right but not the obligation to monitor and edit or remove any activity or content.     When you visit GFM.tv or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Consent To Our Communication With You By E-Mail. By establishing a My Account with us, and each time you make a listing or changes through our Site, you grant permission for GFM.tv to contact you at your e-mail address. To stop receiving our marketing emails, click on Notification setting in your account and set whatever you want to receive or not.

Transactions between Buyers and Suppliers

    1. Users are hereby made aware that there may be risks of dealing with people acting under false pretences. GFM.tv uses several techniques to verify the accuracy of the information our users provide us when they register on the Site. However, because user verification on the Internet is difficult, GFM.tv cannot and does not confirm each User's purported identity (including, without limitation, Verified Label Holder Members). We encourage you to use the various tools available on the Site, as well as common sense, to evaluate with whom you are dealing.

    2. Each User acknowledges that it is fully assuming the risks of purchase and sale transactions when using the Site to conduct transactions, and that it is fully assuming the risks of liability or harm of any kind in connection with subsequent activity of any kind relating to products or services that are the subject of transactions using the Site. Such risks shall include, but are not limited to, mis-representation of products and services, fraudulent schemes, unsatisfactory quality, failure to meet specifications, defective or dangerous products, unlawful products, delay or default in delivery or payment, cost mis-calculations, breach of warranty, breach of contract and transportation accidents. Such risks also include the risks that the manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Site may violate or may be asserted to violate Third Party Rights, and the risk that User may incur costs of defense or other costs in connection with third parties' assertion of Third Party Rights, or in connection with any claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by Third Party Rights claimants. Such risks also include the risks that consumers, other purchasers, end-users of products or others claiming to have suffered injuries or harms relating to product originally obtained by Users of the Site as a result of purchase and sale transactions in connection with using the Site may suffer harms and/or assert claims arising from their use of such products. Each User agrees that GFM.tv shall not be liable or responsible for any damages, liabilities, costs, harms, inconveniences, business disruptions or expenditures of any kind that may arise a result of or in connection with any Transaction Risks.

    3. Users are solely responsible for all of the terms and conditions of the transactions conducted on, through or as a result of use of the Site, including, without limitation, terms regarding payment, returns, warranties, shipping, insurance, fees, taxes, title, licenses, fines, permits, handling, transportation and storage.

    4. In the event that any User has a dispute with any party to a transaction, such User agrees to release and indemnify GFM.tv (and our agents, affiliates, directors, officers and employees) from all claims, demands, actions, proceedings, costs, expenses and damages (including without limitation any actual, special, incidental or consequential damages) arising out of or in connection with such transaction.

Purchase Products/Services

    Conditions of Sale and Payment Terms: To use services on our Site, you must be at least eighteen (18) years of age or the applicable state/country age of majority. Prior to the purchase of any services on our Site, you must provide us with a valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration and (v) any activation numbers or codes needed to charge your card. By submitting that information to us, you hereby agree that you authorize us to charge your card at our convenience but within thirty (30) days of credit card authorization. All sales of products and services are final. All charges from those sales are nonrefundable.

Purchase Acceptance Policy (Membership, Order Advertising services)

    Your receipt of an electronic or other form of purchase confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. GFM.tv reserves the right at any time after receipt of your order to accept or decline your order for any reason. Your order will be deemed accepted by GFM.tv upon performance of services that you have ordered, or upon the completion of the license and delivery of a Digital Download, as indicated by our servers. Title to goods and all risk of loss passes to you upon delivery to the common carrier. All orders placed over $1000.00 () must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.

    No Responsibility To Sell Mis-priced Products Or Services: GFM.tv shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. GFM.tv shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, GFM.tv shall immediately issue a credit to your credit card account in the amount of the charge.

    Modifications to Prices or Billing Terms: GFM.tv RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS FOR PRODUCTS OR SERVICES SOLD, EFFECTIVE IMMEDIATELY UPON POSTING ON THE SITE OR BY E-MAIL DELIVERY TO YOU.

    Taxes: You agree that you and seller are responsible for determining the amount of sales, use or other taxes that you may owe as a result of your Marketplace purchase. You are responsible to collect, report and remit any sales, use or other taxes required under applicable law. You agree (a) that GFM.tv has no responsibility to collect, report or remit sales, use or any other applicable taxes in connection with your purchase, and (b) to fully indemnify, defend and hold GFM.tv and each seller harmless from any and all claims, demands, damages, awards, fines, costs, expenses and liability in any way associated with foregoing. Without limiting the generality of the foregoing.

    The GFM.TV (GLOBAL FILM MARKET INC.) may contain links to others ("Linked Sites").

    Though all care would be taken to check the content of the site to be appropriate in all respects for general public, however:

No Unlawful or Prohibited Use

  12. link directly or indirectly to or include descriptions of goods or services that are prohibited under this Agreement;

  13. violate any provision in the Product Listing Policy;

  14. otherwise create any liability for GFM.tv or its affiliates.

Networking

    Your interactions with other Members in connection with the Services or with advertisers, including, without limitation, payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the other Members or the advertiser. You agree that GFM.TV (GLOBAL FILM MARKET INC.) will not be responsible for any loss or damage incurred as the result of any such dealings or with respect to any other Member's use or disclosure of your personally identifiable information. If there is a dispute between you and any third party (including, without limitation, any Member), GFM.TV (GLOBAL FILM MARKET INC.) is under no obligation to become involved; however, we reserve the right, but have no obligation, to monitor disputes between you and other Members.

    You agree not to reproduce, retransmit, disseminate, sell, distribute, perform, display, publish, broadcast, circulate, create new works from, or commercially exploit the Services (including the content and information made available through the Services), in whole or in part, in any manner, without the express written consent of GFM.TV (GLOBAL FILM MARKET INC.), nor to use the content or information made available through the Services for any unlawful purpose. Copyrighting your Submissions (Including Video)

    All persons and companies submitting music, writing, film, video or any other kind of copyrightable materials are urged to copyright the material prior to submission. GFM.TV (GLOBAL FILM MARKET INC.) is not responsible for any copyright damages; abuse or copying of submitted materials, or any other losses or damages resulting from submission of materials to our reviewers or staff.

    In certain circumstances you may choose to submit film, video, music or other creative material (collectively, "Materials") to GFM.TV (GLOBAL FILM MARKET INC.) for the purposes of GFM.TV (GLOBAL FILM MARKET INC.) providing to you, at your request, exposure to parties seeking to hire, license or procure film, television, video game and other film related projects, or other services.

    With regards to all video and any other creative Material you submit to GFM.TV (GLOBAL FILM MARKET INC.) through any of our websites or otherwise, you expressly authorize GFM.TV (GLOBAL FILM MARKET INC.) to transmit, stream, download, transfer, broadcast, publicly display and publicly perform in any manner, form or media whether now known or hereafter devised, any of the Materials you submit to GFM.TV (GLOBAL FILM MARKET INC.) for demonstration purposes only, SOLELY IN CONNECTION WITH THE SITE(S) YOU SUBMIT THE MATERIALS TO. Without limitation to other licenses you may be inferred to have granted in order to accomplish the foregoing, you expressly grant to GFM.TV (GLOBAL FILM MARKET INC.) the following licenses with respect to any and all Materials you submit.           

Public performance license for video

    Whether or not you are a member of a performing rights society, you hereby grant GFM.TV (GLOBAL FILM MARKET INC.) a nonexclusive, direct license to publicly perform all video included in your Materials, worldwide, for demonstration purposes. If you belong to a performing rights society you understand that it is your sole responsibility to notify your performing rights society of the direct license you have granted herein.            

Public performance license for sound recordings

    You hereby grant GFM.TV (GLOBAL FILM MARKET INC.) a nonexclusive license to publicly perform by means of digital audio transmission all sound recordings included in your Materials, worldwide, for demonstration purposes.

Reproduction licenses for compositions and sound recordings

    You hereby grant GFM.TV (GLOBAL FILM MARKET INC.) nonexclusive reproduction licenses for all compositions and sound recordings included in your Materials limited to reproducing by download the Materials for demonstration purposes.

User Forum

    The Site may include bulletin boards, Messenger or other user forums ("Forums").

    Such Forums are provided to give users an interesting and stimulating platform to express their opinions and share their ideas and information with similar minded users.

    You are cautioned that certain message boards and similar user forums may disclose a user’s IP address along with the user’s name and message.

    To protect your safety, you are supposed to use your best judgment when using these forums, and consider carefully whether you want to disclose any information that can be used to identify or locate you.

FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND.

    GFM.TV (GLOBAL FILM MARKET INC.) AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GFM.TV (GLOBAL FILM MARKET INC.) AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE GFM.TV (GLOBAL FILM MARKET INC.), WITH THE DELAY OR INABILITY TO USE THE GFM.TV (GLOBAL FILM MARKET INC.) OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE GFM.TV (GLOBAL FILM MARKET INC.), OR OTHERWISE ARISING OUT OF THE USE OF THE GFM.TV (GLOBAL FILM MARKET INC.), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF GFM.TV (GLOBAL FILM MARKET INC.) OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

    IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE GFM.TV (GLOBAL FILM MARKET INC.), OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE GFM.TV (GLOBAL FILM MARKET INC.).

Termination/Access Restriction

    GFM.TV (GLOBAL FILM MARKET INC.) reserves the right, in its sole discretion, to terminate your access to the GFM.TV (GLOBAL FILM MARKET INC.) and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of California, . and you hereby consent to the exclusive jurisdiction and venue of courts in Los Angeles, California, . in all disputes arising out of or relating to the use of the GFM.TV (GLOBAL FILM MARKET INC.). Use of the GFM.TV (GLOBAL FILM MARKET INC.) is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and GFM.TV (GLOBAL FILM MARKET INC.) as a result of this agreement or use of the GFM.TV (GLOBAL FILM MARKET INC.).

    GFM.TV (GLOBAL FILM MARKET INC.)’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of GFM.TV (GLOBAL FILM MARKET INC.)’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the GFM.TV (GLOBAL FILM MARKET INC.) or information provided to or gathered by GFM.TV (GLOBAL FILM MARKET INC.) with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

    Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and GFM.TV (GLOBAL FILM MARKET INC.) with respect to the GFM.TV (GLOBAL FILM MARKET INC.) and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and GFM.TV (GLOBAL FILM MARKET INC.) with respect to the GFM.TV (GLOBAL FILM MARKET INC.).

    A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

    It is the express wish to the parties that this agreement and all related documents be drawn up in English.

Refund Policy

    There are no refunds for any order or services submitted for GFM.tv services and products.
